| The services
provided by Custom Training, LLC (the "corporation"),
are based upon scientific principles and knowledge that are contstantly
being changed and updated. Customers make certain representations
as to their physical condition, their workout regimen, and their
diet, which cannot be confirmed or denied by the corporation. The
corporation also provides links to information provided by other
entities for which it makes nor representations or warranties
thereto. Anyone accepting the services provided herein assumes the
risks inherent in exercising, dieting and natural physical changes
therefrom and holds the corporation free from any liability for
damages or a refund. Under no circumstances, and under no legal
theory, will the corporation be liable to you for any damages,
including lost profits, lost date, or other indirect, special,
incidental or consequential damages arising out of the use,
reliance, or inability to use or rely on information provided by
the corporation, even if the corporation, its licensors, authorized
dealers, or authorized agents have been advised of the possibility
of such damages, or for any claim by any other party. The
limitation from liability shall apply to death and personal injury
to the maximum extent permitted by law. Your sole and exclusive
remedy for any breach of warranty or purpose is the corporation
will, at its option, either review and revise your information or
provide credit for additional services. To the maximum extent
permitted by applicable law, the corporation and its licensors,
disclaim all other warranties, express or implied, by statute or
otherwise, regarding any services provided, including fitness of a
particular purpose, quality, merchantability or accurateness. No
oral or written information or advice provided by the corporation,
its licensors, their respective employees, distributors, dealers or
agents shall increase the scope of the above warranties nor create
new ones. The corporation relies upon New Jersey law and provides
that the maximum liability under the warrant as set forth above is
limited to the amount paid by the customer for the particular
services complained of. If applicable law does not support the
exclusion, then in any event, any implied warranties are limited in
duration to 60 days from purchase, with proof. |
